What changed in Australian privacy law, and what applies to you.
Australia updated its privacy law in late 2024. Three changes matter for a trade business, and we will tell you plainly which ones reach you.
1. Anyone can sue you directly now.
Since 10 June 2025 a person can take you to court for a serious invasion of their privacy. The regulator says this right is broader than the rest of the Privacy Act. It reaches every business and every sole trader. Your turnover does not matter.
2. The main rulebook still has a size limit, for now.
The Australian Privacy Principles bind businesses over $3 million in turnover, plus some types of business regardless of size. Most trade businesses sit under that line today. The government has said it wants to remove that exemption. No date is set.
3. AI decisions must be disclosed from 10 December 2026.
If the Privacy Act covers your business and you use AI to make or heavily shape customer decisions, your privacy policy must say so from that date. An AI voice agent or an AI quoting tool counts.

For a company the Act covers, the maximum penalty for a serious or repeated breach is the greater of $50 million, three times the benefit, or 30% of adjusted turnover. For an individual it is up to $2.5 million.
